SUBARU WINTER SERVICE PROMOTION - CONDITIONS OF ENTRY
1. Information on how to enter forms part of these Conditions of Entry. Participation in this promotion constitutes acceptance of these Conditions of Entry.
2. Entry is open to all Australian residents over the age of 18, apart from directors, officers, managers and employees of the Promoter and the agencies and companies associated with this promotion and the immediate families of these persons.
3. The competition commences at midnight AEST on 01/06/08 and ends at midnight AEST 31/08/08 (the “Promotion Period”).
4. To enter, participants must have their Subaru vehicle serviced or repaired (excluding warranty work) at an Authorised Subaru Retailer and then proceed to www.subaru.com.au (the “Website”) and follow the instructions on how to enter and register online. All fields on the entry form are to be completed. Entry via the Website is restricted to one entry per person. Entry via the Website is free, however, any costs associated with accessing the Website are the responsibility of the person seeking access and are dependent on the internet service provider used. Entrants must make their Website entries manually using an internet browser. The Promoter may reject entries if it reasonably forms the opinion that an entry has been made using automated entry means or by use of a computer entry service. Entrants must ensure that the Promoter receives their entries during the Promotion Period. All entries are deemed to be received at the time of receipt by the Promoter, not time of transmission by the Entrant. The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries. Any entry that is made on behalf of an entrant by a third party or otherwise by proxy will be invalid.
5. Only Subaru vehicles that are serviced or repaired (excluding warranty work) at an authorised Subaru Retailer’s service centre will be deemed acceptable for the purposes of an entry to the competition.
6. The winning entry will be audited to confirm that the Conditions of Entry have been met.
7. Each valid entry entered over the duration of the Promotion Period will be entered into the draw. One entry will be drawn at random to become the winner. The electronic computerised draw will take place at belong Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000, on 08/09/08 at 12.00pm (AEST).
8. The winner will win their choice of a Jayco Swan Camper Trailer Standard (valued at up to $26,000 RRP) or a Quintrex 470 Freedom Sport C.V. Boat including Mercury 60hp Outboard motor and trailer (valued at up to
$26,000RRP), to be picked up by the winner from their Subaru Retailer. The Promoter will only be responsible for transportation costs to the winner’s Subaru Retailer. All other transport costs shall be at the winner’s expense.
9. The prize is valued at up to $26,000 RRP (inc GST) and includes all associated registration costs. The value is accurate as at the commencement of this promotion and the Promoter accepts no responsibility for any variation in the value of the prize after that date. The prize cannot be redeemed for cash or any other consideration. The winner may be required to obtain a licence to use the prize and to obtain additional equipment to tow the prize (e.g. tow bar) and by entering the winner acknowledges that all costs associated with obtaining such licences and equipment will be at the winner’s expense.
10. The Promoter reserves the right to request the winner provide proof of purchase (repair order), proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the discretion of the Promoter. If the winning entry is deemed not to comply with the Conditions of Entry, the winner fails to produce the proof required or if the winner is found to have tampered with the entry process or the operation of this promotion the entry will be declared invalid and a new winner of the prize will be determined by drawing a further entry.
11. The final winner will be notified by mail, email and phone and his/her details will be published in The Australian on 15/09/08. The Promoter may also publish the name and the State/Territory of residence of the winner on its’ website or in a trade publication but agrees that it will not publish the full address of the winner.
12. By entering this promotion the winner agrees, at the Promoter’s request, and free of charge, to participate in all promotional activities (including publicity and photography) surrounding the winning of their prize, and he/she consents to the Promoter using his/her name and image in promotional material.
13. The Promoter and its’ associated agencies and companies shall not be liable for any loss or damage whatsoever which is suffered by the winner and/or their family members or associates (including but not limited to indirect or consequential loss) including personal injury including death which is suffered or sustained in connection with accepting or using the prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its’ associated agencies and companies will not be liable for any damage to a prize in transit.
14. In the event of the prize not being accepted or claimed within 3 months of the draw, the winner’s entry will be deemed invalid and the Promoter reserves the right to conduct such further draws on the 08/12/08 at the same time and location as the original draw as are necessary to distribute the prize, subject to any written directions given by any relevant authority.
15. All disputes regarding these Conditions of Entry shall be referred to the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
16. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose the entrants’ personal information to its’ contractors and agents to assist in conducting this promotion or communicating with entrants and to State/Territory lottery departments and the winners’ name may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles contained in the Privacy Act 1988.
