Symmetry Magazine – ’Your Say’ Promotion

1.      Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.

2.      To be eligible to win entrants must write a letter/email of no more than 500 words addressing a question associated with Subaru or discussing Subaru and send it to:

3.      Entry is only open to Australian residents aged 18 years or over.  Employees (and their immediate families) of the Promoter, Subaru Retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

4.      The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5.      Incomplete, indecipherable or illegible entries will be deemed invalid.

6.      The Promotion commences on 05/02/2013 and ends on 05/05/2013  (“Promotional Period”).  Only one entry permitted per person throughout the Promotional Period.  All entry letters/emails must be received by no later than 11:59pm AEST on 05/05/2013. Entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.

7.      This is a game of skill and chance plays no part in determining the winner.  The winner will be selected by our panel of judges based on the creativity of the entry submitted.  The judges’/Promoter’s decision is final and no correspondence will be entered into.

8.      The prize is a Philips – Jamie Oliver HomeCooker (RRP $529.95).

9.      The prize winner will be notified by phone/mail and their name together with the winning entry will be published in the next edition of Symmetry Magazine.

10.  If any prize is unavailable or otherwise unable to be supplied, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

11.  Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

12.  By submitting an entry, entrants consent to the Promoter using the entrant's winning entry (either in full or in part), name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording including to reproduce or publish such material in any medium) for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

13.  If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

14.  Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), forany personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);(b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) redemption or use of a prize.

15.  The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.  

16.  By entering the competition entrant’s are deemed to have accepted these terms and conditions and to have expressly consented to the use of their personal information for the purpose of the Privacy Act, Spam Act and other related privacy legislation. Entrant’s acknowledge and agree that the Promoter may, for an indefinite period, unless otherwise advised by the entrant, use such personal information for Promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Personal information will only be used in accordance with the Promoter’s privacy policy. The Promoter will also endeavour to provide the entrant with an option to opt out of receipt of such communications every time the Promoter contacts them. Entrants should direct any request to access, update or correct information to the Promoter.

"SUBARU WIN A REAL TOUR EXPERIENCE IN FRANCE" PROMOTION

TERMS AND CONDITIONS

Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to Australian residents aged 18 years or over who: (a) are available to take the prize between 12/07/2013 and 22/07/2013; and (b) are able to elect a companion who is an Australian resident aged 18 years or over who is also available to travel between 12/07/2013 and 22/07/2013. Employees (and their immediate families) of the Promoter, participating Subaru dealerships and agencies associated with this promotion are ineligible to enter.

Promotion commences on 01/04/2013 and closes at 11.59pm AEST on 31/05/2013 (“Promotional Period”).

To be eligible to enter, eligible individuals must, during the Promotional Period, book a test drive of any new Subaru vehicle via the www.subaru.com.au/real-tour competition page, input the requested information, and agree to the Terms and Conditions by clicking on the relevant box.  Individuals who enter the competition and satisfactorily complete a test drive will receive a single (1) chance to win out of the total competition entries.  Individuals who complete a test drive and later purchase a new Subaru vehicle during the Promotion Period and take delivery of that vehicle between 01/04/2013 and 31/05/2013 will receive one hundred and one (101) chances to win out of the total competition entries. It is the responsibility of such entrants to ensure that their Subaru Retailer completes a Retail Delivery Advice (RDA) to receive the 100 bonus points. Members of Cycling Australia, Triathlon Australia and Orica GreenEDGE are eligible to receive one (1) additional entry point by adding their membership information. Provision of incorrect membership information will result in the one (1) additional entry point being deemed invalid.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Incomplete or indecipherable entries will be deemed invalid.

Only one (1) entry permitted per person, regardless of the number of test drives taken or vehicles purchased.

The draw will take place at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250 on 07/06/2013 at 12.00pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 14/06/2013. The Promoter’s decision is final and no correspondence will be entered into.

The first valid entry drawn will win a trip for two (2) adults to France valued at up to AU$32,800 depending on point of departure. The prize is a Cycling Australia Tour package provided by Cycling Australia (ABN 36067389259) which owns and operates Cycling Australia Tours and includes: return economy airfares from winner's nearest capital city to Sydney, NSW (if necessary); return economy airfares from Sydney, NSW to France; 10 nights 4 and 5 star accommodation including breakfast daily, 5 dinners (includes Cocktail Party) and 5 lunches, Cycling Australia Tours kit including official polo, Tour de France kit including the official Tour de France Road Book, accredited guide support throughout, extensive touring and private sightseeing experiences as outlined in the tour dossier, luxury private coach transfers & TGV 1st Class Trains, Cycling Australia cocktail party in Paris, reserved Grand Stand seating on the Champs Elysees for the race finish, behind the scenes access to the race with your ‘Directeur Sportif’, Scott Sunderland, discounts at the official Tour de France merchandise outlets, local taxes included and a $5,000 VISA card for the winner. Prize must be taken to coincide with the Le Tour de France 2013 event with flights departing on 12/07/2013 and is subject to booking and flight availability.

The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.

The winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

The opportunity to attend any event prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

Total prize pool value is up to $32,800. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

A draw for the prize, if unclaimed, may take place on 14/06/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. In the case of a winner, they will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 28/06/2013.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Tour De France or any event awarded as part of the prize is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.

As a condition of accepting the prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
